ABIM supports BERSOH 3.0

BERSIH 3.0 Jom Duduk Bantah protest at Dataran Merdeka to pressure for BERSIH 2.0 8 demands and new demands for EC to resign, foreign observers and all reforms to be implemented before the general elections has got further support from ABIM (Angkatan Belia Islam Malaysia, ie. the Malaysian Islamic Youth Movement. It's President Amidi Abdul Manan urged EC to be proactive and serious with regards to handling demands of BERSIH and the people. Muslim NGO Abim also expressed its support for the Bersih cause and its backing for peaceful demonstrations as a manifestation of the people's protest against weaknesses in running fair elections. Abim president Amidi Abdul Manan (photo below) said elections were a mechanism to manage the differences in political beliefs of a country harmoniously, if these were carried out well. "Hence, it is vital to have various institutions, including the Election Commission, so that the people's trust can be regained. Abim urges the EC to be proactive and serious in handling all the complaints made by Bersih 3.0 and the people. "Scrutinise the demands and complaints made, and clear the electoral roll, the management of postal voters and provide equal access to the media," Amidi said. He warned that EC's failure to attend to the complaints of the people would create a negative perception about the commission. Looking at the current political scenario, it would be vital to improve the electoral roll as failure to do so would create a murky political situation that would prevent the smooth running of the 13th general election. "I also call on all Malaysians to come down to join the protest," Amidi added.

Election Offences Act amendments - BN attempt to steal GE 13

Last Thursday, the BN government and their cohorts the SPR clearly demonstrated in unequivocal terms their intent to steal GE 13. They presented a bill to amend the Election Offences Act 1954 to further restrict scrutiny of the voting process by representatives of political parties and make the system more amenable to manipulation.

The original changes proposed included the following: a. removing the right of political parties to set up booths to assist voters establish their names on the electoral roll and saluran numbers identity of voters before going into polling stations (called "pondok panas") [section (26)(1)(e)]

b. removing the right of political parties to have representatives observing the process in the SPR booths inside polling stations ( Barung SPR ) where voters check their names and get their saluran numbers etc [section 26A] c. amending section 14 (1A) so that the SPR would dictate the time of arrival and departure of polling and counting agents of candidates at polling stations. The current law provided for polling and counting agents to arrive at the time decided by the political parties as long as they stayed at the polling stations for at least 2 hours. The net effect of these changes would have been to greatly reduce the current scrutiny of the voting process.

Pakatan Rakyat MPs put up strenuous objections to the amendments. Opposition Leader Anwar Ibrahim warned the BN in the closing words of his speech on Thursday morning that these new provisions would be defied by the opposition even if passed by the BN. He said that Pakatan Rakyat would not give up the established rights under the law which aided transparency in the process. The BN in the afternoon of Thursday then presented fresh amendments to the Bill backing down on (a) and (c) above restoring the status quo. However they used their brute majority in the House to ram through the amendment removing party representatives observing the process in the SPR Barung.

Opposition MPs argued to no avail that the SPR Barung was initiated by the BN by amendments in 2003 to assist voters to get their electoral and saluran numbers and had been implemented in the 2004 and 2008 elections without any issues. The lame justification put forward by the BN and the SPR was that "this causes difficulties to the election workers". When asked for reports of such "difficulties" none were cited.

Another controversial amendment pushed through was the removal of section 11(1)(c) requiring all printed material during campaign to bear the name of the publisher and printer. Removal of the onerous requirement of naming the printer all the time would have improved the provision as was argued by PR MPs. However removing it all together has opened the door to a dirtier election where all sorts of defamatory or inflammatory material could be put out without anyone taking responsibility for them.

What was apparent was that the BN and SPR were not interested in presenting the necessary amendments to the law to implement KEY recommendations by the Parliamentary Select Committee on Electoral Reform. Nothing had been done for example on key issues such as access to the media and the question of how a caretaker government. Even the regulations to implement "early voting" which was to replace the so-called postal voting system for army personnel, their spouses and police personnel were not presented to Parliament by the last day of the sitting leaving open the question of whether the BN and SPR were going to implement this key change for GE 13.

These legislative moves by the BN and SPR on Thursday made it clear that their real intent was to make the electoral process less transparent and easier to manipulateIt is clear that BERSIH 3.0 is needed even more than before. BERSIH's demand that the key recommendations of the PSC report must be implemented before GE 13 is central to a free and fair election. The Election Commission must resign for the legislative fiasco they caused in Parliament on Thursday and for their intransigence in implementing the PSC report and BERSIH demands. “Bersih 3.0 静坐抗议”八大诉求：
1. 清理选民册；
2. 改革邮寄选票制度；
3. 使用不褪色墨汁（点墨制）；
4. 自由与公平的媒体报导；
5. 最少21天竞选活动期限；
6. 强化公共机构；
7. 杜绝贪污；
8. 杜绝肮脏政治手段。
净选盟 3.0督导委员会
由拿督安美嘉（前马来西亚律师公会主席）领导的净选盟3.0 是由一些非政府组织领袖与活跃人士组成。
我们预计这一次的集会将吸引各种族人民参与，各种思想与信仰的 人民将聚集在一起表达他们的主张，尤其是针对要求选举委员会改革来届大选的选举制度。

为了确保集会能在平和有序的情况下进行，我们特此拟定了一份集 会指南指引大家。希望这份指南能协助主办单位与集会出席者在和平安全的情况下顺利完成 “Bersih 3.0 静坐抗议”大集会。

A. 出席者须携带/准备事项：
1. 身份证、驾驶执照和一张提款卡（ATM card）；
2.避免携带太多现金或穿戴贵重首饰，建议最多携带RM100 现金；
3.请保持衣着端庄，着黄色衣服/T恤，最好带有 Bersih 3.0标志 ；
4.穿上方便行动的包鞋或运动鞋；请勿穿高跟鞋或拖鞋；

5.配件方面，出席者只可携带附有净选盟3.0/要求干净选举 /净选盟2.0八大诉求标语和标志的徽章、头巾、臂章、小旗帜、 布条和标语牌；

6.可携带马来西亚国旗或各自的州旗；
7. 矿泉水、简单的食物或糖果以补充体力；
8. [这一项非常重要] 携带一小包食盐 ：食用少许食盐可以减轻催泪弹和水炮所引起的不适（食用而 不是用来涂在脸上）；
9.面巾或毛巾 - 当警方发射催泪弹的时候，湿毛巾可以用来掩护鼻子和眼睛， 避免直接接触到刺激性气体；

10.建议出席者带上口罩或者面罩，避免在人潮拥挤的地方接触 到一些病毒（比如说H1N1病毒），也可避免在警方发射催泪弹时吸入过多的刺激性气 体。适用的口罩 和面罩型号包括：N100 Respirator, N95 Respirator 和 Surgical facemask；

11.倘若您患有哮喘病或者其他疾病，请自备您所需的药物及呼吸辅助器。
12.请携带一些小型垃圾袋，并勿随地乱丢垃圾；
13.笔和小型笔记本，以便在被警方查询的时候记下警员的名字和编号，或者 记下任何行迹可疑的人物或事项；
14.请别忘了携带摄影器材，包括：数码相机、录影机、附有摄 影功能的手机，以记录集会当天的实况。在此呼吁大家在集会结束后把所拍摄 到的相片或视频传送到净选盟秘书处电邮。
B. 出席者不被允许的事项：
1. 学生请勿携带学生证；公务员和在私人领域工作的人士请勿携带工作证。
2. 请勿携带信用卡或太多现金，以免在集会或被逮捕时被扒走或丢失。
3. 请不要穿有碍行动的拖鞋、高跟鞋或凉鞋。
4. 请不要穿纱笼或裙装，主办当局鼓励出席者穿裤装出席。
5. 请勿佩戴与Bersih 3.0/要求干净选举无关的首饰或配件。
6. 请勿携带任何有政党党徽及组织标志的布条、标语牌和旗帜。
7. 任何与Bersih 3.0诉求无关的口号都不被允许。
8. 除了笔之外，请勿携带任何尖锐的物品。
9. 请勿携带任何能引爆或易燃物品，如火柴、汽油弹、爆竹等。
10.集会时禁止吸烟，因为吸烟将对他人造成困扰。
11.请勿携带任何武器和危险物品，如木条、铁条、铁链、枪械等。
12.携带小孩的出席者请勿携带以武器为造型的玩具如玩具枪、玩具刀等。
13.请勿携带10岁以下的孩童出席，以免造成不便。
C. 集会前应准备的事项：
1. 检修您的交通工具及检查需带去集会场地的器材与物品。
2. 集会前请勿过量饮食。
3. 穆斯林在进入集会场地前，确保已“还愿”。
4. 穆斯林在集会前请作忏悔及祝福的祷告，祈愿真主保佑集会顺利；非穆斯 林则可根据各自的信仰仪式祷告。
5. 出门时确保家门已上锁，您也可向没出席集会的家人或邻居作重要交待。
6. 通知他们您出门的目的。
7. 告诉他们与您同行友人的电话号码，以备他们无法与您取得联络之需。
8. 别忘了为您的手机和相机充电。
9. 确保您知道如何到达集会地点，即独立广场。
10.提早出发，以免遇上交通阻塞，或被迫在轻快铁站或电动火车站购票处排 长龙。
11.携伴同行，不要单独行动。

12.倘若您在前往集会地点时遇到路障，被禁止驶入市中心，你 可以在泊好车子后步行到独立广场（请勿单独前往国家皇宫）。

13.集会前请不要先穿上Bersih 3.0的衣服。
D. 集会及游行进行时应注意的事项：
1. 在独立广场集合，并等候“现场指挥官”的指示。
2. 集会时全程遵从伊斯兰党志工团(Unit Amal)或“现场指挥官”的指示，在没向“现场指挥官” 咨询之前，不要理会其他人的指示。
3. 除非是“现场指挥官”的指示，否则请勿擅自离开集会地点。
4. 若发现任何可疑事物，请向值勤的志工团成员报告。
5. 集会和游行进行期间，切忌互相推挤。
6. 集会进行时不要辱骂、咒骂他人或展示任何不雅手势。
7. 以和平和谐的方式参与这场集会。
8. 让路给经过的交通工具，不要随意过马路。
9. 让参与集会的乐龄人士、残障人士和孩童有优先待遇，帮助及保护他们。
10.倘若您有急事或需要上厕所而必须离开集会地点，通知您的朋友，以免造 成不便。
11.领导人致辞时请不要聊天，因为成千上万出席者说话的声浪会盖过现场的 音响。
12.需要时，请跟着领导人喊口号。
13.集会时手持马来西亚国旗或各自的州旗。
14.集会时勿乱丢垃圾，把垃圾收进你自备的垃圾袋里。
15.以相机或摄影机拍下集会的情形，并于集会后将照片或视频传寄给我们， 您可透过电邮/电话联络净选盟 3.0秘书处
16.情况允许的话，拍下值勤警察的样貌或重要的不幸事件（若有），如警察 使用暴力对付集会者或挑衅集会者等。
E. 集会结束后：
1.在接获集会解散的指示后，请以和平的方式慢慢解散。
2.集会结束后，确保您的朋友、亲人和小孩都在身边。如果他们 不在身边，而您又找不到他们，请向净选盟3.0秘书处报告。
3.若您的朋友或亲人被逮捕，不要直接回家，请向净选盟3.0秘书处询问相 关讯息。
4.不要在集会场地留下任何垃圾，把所有垃圾丢进垃圾桶，或带回家丢弃。
5.倘若集会顺利举行，解散时请向值勤的警察和联邦镇暴队成员道谢。

6.别忘了与您的所有朋友，特别是没有出席者，分享集会的照片 和新闻。所有讯息和资料都可以电邮给净选盟3.0秘书处。

F. 面对“Bersih 3.0 静坐抗议”反对者的挑衅时，您该怎么做？

1.别理会他们，保持沉默，继续遵从“现场指挥官”和志工团的指示。
2.不要回应他们的挑衅，不要抛掷任何东西，不要对他们做任何手势，当他们 不存在。
3.别靠近他们。
4.如果他们突然攻击您，请忍耐，别还手，把他们交给警方处置。
5.如果他们致伤或骚扰您，别忘了报警举报他们。
6.如有需要，拍下他们的样貌。
G. 面对警察的挑衅或攻击时，您该怎么做？
1.除非集会领导人发出指示，否则不要跑离集会处。擅自离队者更容易被逮 捕。
2.不要落单。当警察作势要进攻或发射水炮时，与其他人手牵手，紧挨着彼此 站在一起。
3.如果领导人指示出席者坐下，请坐下。
4.当警察发射催泪弹时，用一点水沾湿毛巾，然后用毛巾掩面。 如果被水炮车射出的黄色液体射中，用水洗脸及吃一点盐。
5.遇到警察挑衅时，不要还击或与警察争论，您只需保持沉默。
6.如果来得及，拍下他们的样子。
7.倘若您遭遇暴力对待，请报警。

H. 倘若被警方逮捕，您该怎么做？

被警察盘问时：
1. 介绍自己。
2. 您只需告诉警察您的姓名、身份证号码和住址。
3. 如果警察问您其他问题，您可以问他“我是否已被逮捕？(Adakah saya ditahan?)”
几时才算被逮捕？
4.当您问了上面的问题后，如果警察的反应如下，即表示您已被逮捕：
警察答“是（ya）。”
警察给您上手铐，不允许您离开，或要带您到警局。
5.若您没有被逮捕，您可以离开，或拒绝遵从警察要您到警局或其他地方的指 示。
在什么情况下您不能被逮捕：
6.警察不能以‘要求您成为证人’或‘向您录取证人口供’的理由 （Kenyataan saksi 112）逮捕您。

I. 被释放后，您该注意什么？

1. 确保您所有被警方保管的物品都被归还。
2. 倘若您在被扣留期间受伤，请立刻前往中央医院验伤。
3. 倘若您在集会时或被扣留期间受到粗暴的对待，例如被殴打，请立刻报 警。
4. 将您受到警方粗暴对待的经过详情告知您的律师及媒体，并把过程记录下 来。
5.回家后把所有您记得的细节记录下来，以方便日后出庭参考。
6.向保释您的人、律师或任何相关人士索取联络号码或记下他们的号码。
7.把您所有有关大集会的资料、照片或录影都交给您的律师，以方便出庭辩护 时作为参考。
8.被释放后别忘了感谢上苍，并且继续回到您的战友的阵线。
9.不要被警方逮捕或扣留的经历消磨了您的战斗意志，因为这样会削弱您的战 斗动力，您也会因此感到彷徨。
10.继续和其他的战友战斗下去。
11.毫无疑问，您将会因为被逮捕和扣留的经历而变得更勇敢，因为不是所有 人都有这种经历。
J. 注意！！
1. 净选盟将不会为与“Bersih 3.0 静坐抗议”无关的违法行为承担任何责任。
2. 净选盟将不会为个人或团体所作出的挑畔和暴力行为承担任何责任。
3. 净选盟将不会为任何因个人或单位的疏忽，或主办当局指示以外所造成的 伤亡事件承担任何责任。
4. 净选盟将不会为任何因与集会无关的打架或冲突事件而被逮捕的人士承担 任何责任。

*Perkara yang perlu anda bawa/sediakan *
1. Kad pengenalan, lesen memandu, satu kad ATM sahaja.
2. Duit-maksimum RM100 sahaja.
3. Memakai pakaian yang sopan-T-shirt /baju berwarna Kuning. Sebaiknya ada logo Bersih 3.0
4. Setiap peserta diwajibkan memakai kasut.
5. Aksesori kempen-Button, kopiah, arm band, bendera kecil, banner dan placard yang ada Logo atau Slogan Bersih 3.0 / Bersihkan Pilihanraya/Tunaikan 8 Tuntutan SAHAJA boleh digunakan.
6. Bendera Malaysia atau negeri masing-masing.
7. Air mineral, sedikit makanan ringan atau gula-gula.
8. Sedikit garam-ia penting dan boleh dimakan sedikit (bukan sapu dimuka) bagi mengembalikan tenaga terutamanya jika Pihak Polis sembur air dari Water Canon atau Gas pemedih mata.
9. Kain tuala kecil basah untuk tutup mata dan hidung untuk elak terkena gas pemedih mata.
10. Digalakkan memakai penutup mulut dan hidung jenis *N100 Respirator, N95 Respirator *dan* Surgical facemask* untuk mengelak penularan wabak Influenza H1N1 dan juga menghindarkan sedutan gas pemedih mata yang melampau.
11. Jika anda mempunyai asma atau alahan sila bawa inhaler atau ubat sendiri.
12. Sila bawa beg plastik sampah kecil bagi mengelakkan anda membuang sampah merata-rata.
13. Sila bawa pen dan kertas (mini note pad) bagi mencatat nama dan no. pengenalan Polis atau perkara-perkara yang mencurigakan.
14. Jangan lupa bawa kamera, video cam atau handphone berkamera bagi merakamkan suasana himpunan – gambar-gambar atau klip video boleh dihantar kepada kami selepas himpunan di email Setiausaha Bersih 3.0.

*Perkara yang tidak dibenarkan*
1. Jangan bawa kad matrik pelajar bagi student atau pass kakitangan bagi pekerja Kerajaan dan Swasta.
2. Jangan bawa terlalu banyak wang atau kad kredit untuk elakkan penyeluk saku, tercicir atau hilang semasa perhimpunan atau ditahan.
3. Jangan memakai selipar, kasut tumit tinggi atau sandal yang menghalang pergerakkan.
4. Jangan memakai kain atau skirt, digalakkan memakai seluar.
5. Jangan memakai barang kemas atau aksesori yang tiada kaitan dengan tuntutan Bersih 3.0 / Bersihkan Pilihanraya.
6. Jangan bawa sebarang banner, placard, bendera yang melambangkan logo parti dan organisasi.
7. Sebarang slogan yang tiada kaitan dengan tuntutan Bersih 3.0 tidak dibenarkan.
8. Jangan bawa sebarang benda tajam kecuali pen.
9. Jangan bawa bahan-bahan yang boleh meletup atau mudah terbakar seperti, mancis, molotov cocktail dan mercun.
10. Tidak dibenarkan merokok semasa perhimpunan kerana akan menganggu orang lain.
11. Jangan bawa sebarang senjata seperti kayu, besi, rantai besi, pistol dan yang merbahaya.
12. Bagi yang membawa anak-anak, anda tidak dibenarkan membawa permainan yang berupa seperti senjata seperti pistol, senapang atau pisau mainan.
13. Jangan bawa anak-anak yang berumur 10 tahun ke bawah bagi mengelakkan sebarang masalah.

*Perkara yang perlu anda lakukan sebelum perhimpunan*
1. Servis kenderaan dan periksa peralatan yang perlu dibawa.
2. Jangan makan atau minum terlalu banyak sebelum perhimpunan.
3. Pastikan anda telah menunaikan ‘hajat’ sebelum memasuki perhimpunan.
4. Bagi yang Islam, Lakukanlah solat taubat dan hajat, semoga Allah berkati perhimpunan ini dan yang bukan Islam boleh berdoa mengikut ritual masing-masing.
5. Pastikan anda telah mengunci rumah atau meninggalkan pesanan-pesanan penting kepada keluarga atau jiran anda yang tidak pergi perhimpunan.
6. Maklumkan mereka tujuan anda keluar.
7. Maklumkan mereka nombor telefon sahabat lain yang bersama anda jika handphone anda tidak dapat dihubungi nanti.
8. Jangan lupa *charge*bateri handphone dan kamera.
9. Pastikan anda tahu arah tuju anda iaitu tempat berkumpul yang ditetapkan – Dataran Merdeka.
10. Pastikan anda datang awal untuk elakkan kesesakan jalan raya atau terpaksa berbaris panjang untuk beli tiket tren LRT atau Komuter.
11. Datang secara berkumpulan, jangan bersendirian.
12. Sekiranya perjalanan anda dihalang dari memasuki pusat bandar anda boleh meletakkan kenderaan dan berjalan kaki ke Dataran Merdeka (Jangan terus ke Istana Negara bersendirian).
13. Jangan memakai baju Bersih 3.0 sebelum perhimpunan bermula.

*Semasa perhimpunan dan perarakan*
1. Berkumpul di tempat pertemuan yang ditetapkan di Dataran Merdeka dan tunggu arahan dari *Field Commander* yang dilantik
2. Ikutilah arahan dari Unit Amal atau *Field Commander* sepanjang program. Jangan pedulikan arahan lain tanpa merujuk kepada *Field Commander*
3. Jangan berganjak dari tempat perhimpunan melainkan dengan arahan *Field Commander*.
4. Laporkan pada Unit Amal bertugas jika terlihat sesuatu yang mencurigakan.
5. Jangan tolak menolak sepanjang perhimpunan dan perarakan.
6. Elakkan mencerca, memaki hamun atau menunjukkan isyarat lucah semasa perhimpunan berlaku.
7. Raikan perhimpunan ini dengan aman dan harmoni.
8. Pastikan anda memberikan keutamaan laluan kepada kenderaan yang lalu lalang dan tidak melintas sesuka hati dijalanraya.
9. Pastikan anda memberikan keutamaan, membantu dan melindungi warga emas, orang kurang upaya atau kanak-kanak yang hadir bersama.
10. Maklumkan sahabat anda jika anda ingin keluar dari perhimpunan disebabkan hal kecemasan atau kerana ingin ke tandas bagi mengelakan masalah lain.
11. Pastikan anda tidak bersembang semasa pimpinan berucap kerana kemungkinan bunyi *sound system* akan tenggelam dengan suara ratusan ribu peserta.
12. Ikutilah laungan pimpinan jika perlu.
13. Pegang bendera Malaysia atau negeri anda sepanjang perarakan.
14. Jangan buang sampah merata-rata sepanjang perhimpunan. Masukan dalam beg plastik yang anda bawa.

Gerrymandering & Malapportionment - Mother of all electoral abuses

The EC (Election Commission) in cohorts with the UMNO/BN Federal Government and UMNO controlled Parliament has carried gerrymandering and mal-apportionment to such an absurd degree that UMNO/BN can win simple majority with just 15.4% of the total vote.

This is why Malaysians must participate in BERSIH 3.0 to demand for free and fair election, clean electoral roll, reforms before the 13th General Election and the resignation of the EC.

COMMENT I refer to the Malaysiakini report, ‘A retiree exposes gerrymandering in Sabah', and applaud Ng Chak Ngoon for his contribution, especially his graph on the unequal numbers of voters among electoral constituencies.
The delineation of constituencies has long been considered unfair because of two practices that are generally regarded as electoral abuses, namely mal-apportionment and gerrymandering.
Both these practices can have important effects under the first-past-the-post electoral system, which we use in Malaysia.

What Ng has so graphically exposed (chart below) is mal-apportionment or inequality among constituency electorates, rather than gerrymandering. Gerrymandering is the drawing of constituency boundaries for partisan advantage and it can be done even in the absence of mal-apportionment.

Starting with the first constituency revision in 1974, various scholars have noted signs of gerrymandering but the more important source of unfairness in electoral constituencies is mal-apportionment.
The question now is: what can be done to reduce mal-apportionment and gerrymandering in constituency delineation? Three things seem important.
Reform the EC
First, strengthen the independence of the Election Commission (EC), the delineator at first instance. This can be done mainly by improving the process of appointing commission members, just as we have recently done with respect to judges.
The EC should also use its existing constitutional power to appoint its main administrative officials instead of totally relying on federal civil servants.
Second, the EC should report its recommendations on revised constituencies directly to Parliament for approval.
At present, the EC reports to the prime minister, who can then make changes to the commission's recommendations before tabling them in Parliament, and also thereafter, in order to secure their approval by Parliament.
This procedure does not inspire confidence that constituencies will be fairly delineated. An added measure is to require more than the present simple majority (in effect, the support of the ruling party alone) in Parliament for the approval of revised constituencies.
For example, such changes should require concurrent majorities by government and opposition or at least a two-thirds majority of Parliament.
Third, restore the clear numerical limits to mal-apportionment that have been removed from the federal constitution. Some background is useful for understanding the suggested measures.
To safeguard the fundamental principle of approximately equal electorates among constituencies, differences in constituency electorates were limited to 15 percent above or below the average constituency electorate at the time of Merdeka.
No more limits
These clear numerical limits were relaxed in 1962 and then removed in 1973 by constitutional amendments: the federal constitution now allows, rather imprecisely, "a measure of weightage" in favour of rural constituencies.
With clear limits removed, rural weightage has been liberally applied by the EC, even though communications and other disadvantages of rural areas that form the justification for rural weightage have undoubtedly and significantly declined since Merdeka.
Indeed, constituency electorates are now so unequal as to make one wonder whether the fundamental requirement of approximate equality is still being complied with.
For peninsular Malaysia, therefore, it is not unreasonable to restore the limits to mal-apportionment that existed at the time of Merdeka, that is, 15 percent above or below the average constituency electorate.
Conditions in Sabah and Sarawak would justify wider limits than those for peninsular Malaysia. We may restore the limits that were in force when Malaysia was formed.
Those limits allow the largest constituency to have twice the number of electors as the smallest constituency, this is, one-third or 33 percent above or below the average constituency in each state.
This would still represent a considerable reduction from present levels of mal-apportionment in the two states.
Largely, because of mal-apportionment, the practice of constituency delineation is the major cause of unfairness in our electoral system. It causes more unfairness than deficiencies in voter registration and campaign rules.
Indeed, correcting unfairness in constituency delineation is the acid test for the parliamentary select committee on electoral reform and the government.

Lau Weng San's service center

Brief introduction to Mr. Lau Weng San

Lau Weng San is a likely candidate for the state seat of KAMPUNG TUNKU in the Parliamentary Constituent, PJ Utara (Petaling Jaya Utara).

The current assemblyman (ADUN) for the state seat of KAMPUNG TUNKU is Wong Sai Hou who has demonstrated that he did not act in interest of the Petaling Jaya residents as illustrated by the illegal bill board and requirements for advertisers to pay money to the then Petaling Jaya Town Council (MPPJ or Majlis Perbandaran Petaling Jaya) as council member.

Mr. Lau Weng San is the Parliamentary Secretary to Y.B. Lim Kit Siang, the Opposition leader, very likely not drawing a high salary which he might get had he opted to remain in his field of specialization, which is Chemical Engineering. If Mr. Lau wants to become rich, he could have chosen either to pursue a more lucrative career as a Chemical Engineer or join the Barisan. But he joined DAP instead, which is not going to make him rich. Obviously Mr. Lau Weng San will be hard pressed to finance his own service center, but I think he is using the DAP headquarter as his service center.

Federal court judge says public have to live with wrong judgement

And another judge thought that a bridging loan was a loan to construct a bridge. (A bridge loan  also known in some applications as a swing loan is a type of short-term loan, typically taken out for a period of 2 weeks to 3 years pending the arrangement of larger or longer-term financing).

Former High Court judge Syed Ahmad Idid Syed Abdullah said this when revealing glimpses of a forthcoming book about miscues (improper, unlawful or incorrect use) in Malaysian courts for which he wrote the forward.

A book about miscues in Malaysian courts, and confounding and fallacy judgments is in the works and is expected to be out after the 13th general election.
The book, which yet to be titled, will only be published after the upcoming election to ensure politicians do not misuse or abuse its contents.
Former High Court judge Syed Ahmad Idid Syed Abdullah (left) said he was writing the foreword to the book.
Giving some glimpses of the contents, Syed Ahmad Idid said he was informed of a statement made by a judge in the country’s highest court.
“We are the Federal Court, even if we hand you a wrong decision, you have to live with it,” he quoted the judge’s statement and described such statements from the bench as “terror”.
“I can sense that you are keen to know who that judge is and in which case this occurred.

"This book will be published after the 13th general election, in which the authors will offer incorrect statements made in the various courts.

“They (the authors) do not want the politicians to misuse, abuse or use the contents in their confrontation with the opposing parties. It will be about vendetta and abuse of power.
“How do I know about the book? I was invited to write the foreword,” he said.
Syed Ahmad Idid who has authored the 'Writing of Judgments - a Practical Guide for Courts and Tribunals' revealed this in his speech at Universiti Malaya’s ‘Legal Night’ over the weekend.
He also mentioned a case cited in the book where the witnesses had given testimony of land measurement in hectares, but when the judge pronounced the court’s decision the land measurement was in acres.
Art of advocacy 'diminishing'

Syed Ahmad voiced concern that the art of advocacy in courts is diminishing.
“I am saddened ... Many among you who have trained to be advocates or wish in your dreams to appear as successful or famous advocates are disappointed.
“It seems our courts are so crammed with cases that the judges now resort to ‘quickies’ and written submissions.You do not have sufficient time to make your claims or put up your clients’ defence properly."

Syed Ahmad Idid also offered some words of wisdom: “One huge challenge is the negative perception of lawyers and the (present) justice system.
“It is our duty to improve the quality of court-life and judgments. By so doing we can change the perception.”
He advised students to keep themselves up to date with the law.
“It is a necessity and may soon become mandatory! Please prepare your own way and discover as much as possible as to what you must know to facilitate your journey.
“There was no Internet before. We did not know of the galaxy which now makes our earth look like a dot on a piece of paper.
“The present situation requires all of us, myself included, to keep abreast of developments in many fields.
“Of course, we need to be ahead particularly in law and justice. We cannot be like the judge in a matter where he did not know that a bridging loan (or 'swing loan') is a short-term financing arrangement.
“He thought the loan was for the construction of bridges."

Syed Ahmad Idid noted the interesting debate in Kedah following the passage of the Mufti and Fatwa Enactment 2012 last week.
“The former Perlis mufti (Asri Zainul Abidin) had stated that such an enactment was “unIslamic”.
“The exchange of views coming from these two Muslims has invited the MCA to judge whether the fatwa is acceptable or not. I hope you will write an article on this argument.

"You can connect it to other fatwas like those against (Indian author) Salman Rushdie and (Bangladeshi author) Taslima Nasreen and discuss the effect of the fatwa, with one of the longest judgments ever written,” he said without naming the case.
The Kedah legislative assembly passed an amendment to the enactment barring challenges of fatwas in the civil and Syariah Courts.

Students at Occupy Dataran Merdeka appeals for help

Hi People,

By now I think you have all heard that Fahmi and Umar were detained by the police at Dataran Merdeka.

Was told that Fahmi will be released soon, which is about now. I think.

The students at Dataran Merdeka need your help.

Most of their things were confiscated this morning - food, water, tents (more than 60), medicine, umbrellas, toiletries etc.

One SABMer is out buying tents right this moment - money from a generous donor.

Some of the students are highly dehydrated according to a doctor who checked them this morning.

Some are also sunburnt - no tents, no sunblock.

It is heartbreaking that this morning they had not had a meal.

SABMers, can we rely on you to help out in some way or other?

They need regular meals and there isn't much coordination - people have given generously but the timing needs to be regular. There should not be shortage nor should there be waste.

Also, the students are not having enough vegetables and fruit. So please come, support, bring supplies.

Bring towels, fruit, salads, healthy meals, panadol etc.

Let me know if you can contribute and help out.

Most of all, most of all, please know that they need to know we care and are with them.

They are standing up against intimidation and injustice.

We should be with them.

Is Nasharudin Mat Isa an UMNO mole?

Everyone remembered Nasharudin, former Deputy President of PAS, as the person who almost succeeded in killing the cooperation with DAP and PKR by negotiating with UMNO on a pact post March 08.

Now Nasharudin is at it again, but this time dipping his fingers into the affairs of BERSIH 3.0.

Nasharudin was reported as objecting to the leadership of Ambiga to head BERSIH 3.0 as she "supports" LGBT (Lesbians Gay Bisexual Transexual) and that PAS should lead instead.

Now Nasharudin should know that BERSIH is non-partisan and non-political and while welcoming the support and participation of political parties, do not want any political party to lead.

So Nasharudin must be fishing in troubled water by bringing this subject up throwing more suspicions on his motives.

This will be preceded by a forum the night before, this time involving
Ambiga, political scientist Ong Kian Ming and a representative of the
Election Commission (EC).

The forum, entitled 'How Clean will the 13th General Elections Be?' and
organised by NGO Tindak Malaysia, will be held at the Petaling Jaya Civic
Centre at 8.30pm.

According to Tindak Malaysia representative PY Wong, the EC has not yet
responded to the invitation.

"We actually don't expect the EC to respond as their position is
indefensible," he told Malaysiakini.



Round two for Khairy, who is also Rembau MP, will be on May 3 against PKR
director of strategy Rafizi Ramli.

The topic, however, will be on the National Higher Education Fund (PTPTN)
loans.

PKR proposes an abolition of the student loans, while Umno Youth wants the

Forum: “How Clean will the 13th General Elections be?”

On 19th Apr 2012, Tindak Malaysia invited the Election Commission Chairman, Tan Sri Dato’ Seri Abdul Aziz Mohd Yusof, to an open forum entitled How Clean will the 13th General Elections be? to be held at the PJ Civic Centre Auditorium, at 8.30pm Tuesday April 24, 2012. So far, we have not met with a response from the Election Commission. Possibly, the Chairman was too busy rushing the Election Offences Act through Parliament, during its last day of sitting on 19th Apr 2012.

One of the topics to be presented during the forum is:
Problems with the Electoral Roll, by Dr. Ong Kian Ming

It is therefore with deep interest that we read in Malaysiakini on 21st Apr, 2012 the following:
“Despite numerous complaints over the electoral roll, Election Commission chief Abdul Aziz Mohd Yusof declared that Malaysia has the cleanest electoral roll in the world.

In an interview with Sin Chew Daily published yesterday, Abdul Aziz repeatedly stressed that the existing electoral roll is clean and no country in the world has a cleaner one than ours.”

Tindak Malaysia’s founder, Wong Piang Yow, urged the EC Chairman to attend the forum to substantiate his claim to ackknowledged specialists in the field of electoral rolls. “The EC Chairman should not miss such an opportunity to prove the cleanliness of the electoral roll”, stressed Wong. Otherwise, the public may be left with the impression that the EC Chairman’s claims are without substance.

The EC Chairman can also take this opportunity to explain the rationale behind the changes to the Election Offences Act which was just passed by Parliament and why the position of Barung Observer was cancelled.

The invited guests are from the Election Commission, BERSIH 2.0 Steering Committee, academician and political analyst, Dr Ong Kian Ming, and the Election Commission Chairman, Tan Sri Dato’ Sri Abdul Aziz Mohd Yusof.

The moderator will be Syahredzan Johan, the Chairperson of the Bar Council Constitutional Law Committee.

“We would really look forward to the participation of the Election Commission Chairman to have a meaningful exchange,” Wong wrote in a letter addressed to the Election Commission Chairman, Tan Sri Dato’ Seri Abdul Aziz Mohd Yusof. It was hand-delivered to the EC’s office on Fri 20th Apr 2012.
