UMNO Leader's son caught in gerrymandering is Mohd Asri

The face of the UMNO leader son who conspired with EC and NRD in gerrymandering is Muhamad Asri, son of Datuk Yaakub Md Amin, Malacca exco in charge of religion and Adun Umno Sungai Udang.



He claimed that there is nothing wrong in helping change voter addresses, but I had been helping with voter registration and I know that we can only help register new voters, not change addresses of existing voters. That we have to tell them to go to the Post Office.

Malaysians institutions has lost all credibility

The latest regarding that UMNO NRD EC electoral fraud caught on video? is the NRD (National Registration Department) of Malacca claiming that the university had invited NRD to help change student addresses.

They however could not explain controversial statements in the video, that suggest the NRD is helping change the addresses temporarily to give BN an advantage in the coming general election, said to be around the corner.

These government institutions have lost all credibility by this attempt to cover up their shenanigans conspiring with UMNO and EC in this gerrymandering exercise.

It would have been better if they had just shut their mouth.

We all know that Malaysia has become more and more ‘Islamic’ over the last 20 years. By ‘Islamic’ we mean not that people have become more inclined towards personal piety, to strive for establishing justice and mercy on the Earth, etc. Rather we are referring to the external dimension of Islam whereby you see institutionalized religion crystallized in the form of an official bureaucracy that seeks to legitimize itself by exerting social, cultural and political influence on  Malaysia.

There are various reasons for this. Certainly there has been a global resurgence of Islamic identity brought on in different countries for different reasons as a response to modernity, secularism, crass consumerism, colonialism and neocolonialism, export of Saudi ideology funded by Saudi petrodollars. I could go on.

In Malaysia some of these factors are also relevant. But we can also attribute the increase to a concerted effort by the government and ruling party to create and strengthen a series of administrative institutions designed in part to flex Malaysia’s muscles as a modern but very Islamic country. And behind these ostensibly unbiased public policy decisions was certainly some political motives driven by the competition between UMNO and PAS to attract the conservative Malay Muslim voter by being seen as the true defender of the faith.

As of late the rhetoric around Malaysia’s so-called Muslim identity has reached the level of the irrationality. Over the last few years we have seen rulings such as the banning of yoga, the banning of non-Muslims using the word Allah, the enlistment of neighborhood Imams as virtual religious police with the power to arrest. In Kedah, a state governed by PAS under the banner of Pakatan Rakyat, the ruling which makes Islamic fatwas unchallengeable in the court of law is yet another example of the gradual encroachment of Islamic law into the space of Malaysia’s secular legal system.

As an outside observer of Malaysian politics its downright confusing. Where does religious authority lie in Malaysia? With the federal government and its many agencies and bureaus of religion? With the sultan? With the state governments? With imams? What are the legal implications of a fatwa in Malaysia?

Tamir Moustafa, Associate Professor at Simon Fraser University in Canada has a forthcoming article in Law and Social Inquiry entitled “Islamic Law, Women’s Rights and Popular Legal Consciousness in Malaysia. [Tamir Moustafa: Islamic Law in Malaysia]

His article raises some valuable insights about the history and development of Islamic law in Malaysia to better understand some of the questions I raise above. Moustafa’s objective is to understand if there is a disconnect between “fundamental conceptual principles in Islamic legal theory and how those concepts are understood  among lay Muslims in Malaysia.”

It is important to appreciate the theoretical framework of Moustafa’s argument- which is to differentiate between sharia and fiqh. Sharia is the Divine Law as revealed by God. Fiqh is the man made laws and regulations based on authoritative sources of Divine Law: 1) the Quran 2) traditions of the Prophet Muhammed 3) qiyas (analogical reasoning) and 4) ijma’ (scholarly consensus). [In actual fact the methodology is more complex that this and takes into account much more including local custom among other things; however for the purposes of this blog we'll keep things simple].

Moustafa aims to find out how well do Malaysian Muslims understand the difference between the Sharia and the laws that they follow in Malaysia which are said to be Sharia, but which are in actual fact fiqh, by definition, because, as he demonstrates, they are neither based on any direct precedent from the Quran or the Sunnah.

Citing William Roff’s 1967 The Origins of Malay Nationalism

A direct effect of colonial rule was thus to encourage the concentration of doctrinal and administrative religious authority in the hands of a hierarchy of officials directly dependent on the sultans for their position and power. . . . By the second decade of the twentieth century Malaysia was equipped with extensive machinery for governing Islam. (pg 72-73)

Moustafa explains that in the span of less than 100 years there emerged in Malaysia a massive religious bureaucracy intended to centralize control of the the religious life of Malaysia (as opposed to leaving it decentralized and autonomous).

Furthermore what is truly shocking about this institutionalization and codification of the laws governing the Islamic religion is that the Shari‘a Criminal Procedure Act (1997) and the Shari‘a Civil Procedure Act (1997) borrow extensively from the framework of the civil courts in Malaysia. Moustafa says that “[t]he drafting committee literally copied the codes of procedure wholesale, making only minor changes where needed.”

Citing Abdul Hamid Mohamed, former Chief Justice of the Federal Court, who was on the drafting committee for various federal and state shari’a procedures acts in the 1980s and 1990s:

We decided to take the existing laws that were currently in use in the common law courts as the basis to work on, remove or substitute the objectionable parts, add whatever needed to be added, make them Shari‘ah-compliance [sic] and have them enacted as laws. In fact, the process and that “methodology,” if it can be so called, continue until today.

The provisions of the Shari‘ah criminal and civil procedure enactments/act are, to a large extent, the same as those used in the common law courts. A graduate in law from any common law country reading the “Shari‘ah” law of procedure in Malaysia would find that he already knows at least 80% of them . . . a common law lawyer reading them for the first time will find that he is reading something familiar, section by section, even word for word. Yet they are “Islamic law.” (Mohamed 2008, 1–2, 10)27

Moustafa adds that Abdul Hamid Mohamed himself, as well as most other legal personnel involved in the codification of Islamic legal procedures in Malaysia DO NOT have any formal education in Islamic jurisprudence. Let me repeat. The laws that govern Islam in Malaysia were codified by many people who have no formal training in Islamic Jurisprudence.

I’m starting to understand one of the reasons why the issue of authority and Islamic law in Malaysia is so confusing. It’s because the people who set up the system in the first place were themselves likely confused and had no real idea what they were during from the standpoint of Islamic jurisprudence. Whether intentionally or unknowingly, their lack of familiarity with the topics they were confronting was one reason why Islamic legal theory was subverted or ignored even though these individuals probably felt they were working for the sake of Islam.

Moustafa’s conclusion is:

The religious councils, the shari‘a courts, and the entire administrative apparatus are “Islamic” in name, but in function they bear little resemblance to anything that existed before the British arrived. A deep paradox is therefore at play: the legitimacy of the religious administration rests on the emotive power of Islamic symbolism, but its principal mode of organization and operation is fundamentally rooted in the Weberian state  [i.e that state that wishes to have a monopoly of [violent] control over its people].

We’ll review the results of the survey Moustafa conducted in Malaysia on a later post. For now I think it’s worthwhile to discuss what these facts mean for Islam and Muslims in Malaysia.

Politics aside (and politics play an important role no doubt), when Malaysians grapple with the trials and tribulations of how to be a good, practicing Muslim in the modern world, they are not only confronting a formidable adversary in the prevailing materialistic, secular, consumer-driven culture of consumption and instant gratification that is encroaching on every open society.

In addition they have to confront incredibly aggressive and, one might argue, ill-conceived bureaucracy of Islamic affairs that exists throughout Malaysia. Given that many of the laws enshrined in this bureaucracy are not even remotely based on derivations from traditional Islamic sources but are more likely vestiges of British colonial law “adapted” to an Islamic language, what kind of Islam are Malaysians supposed to be following? Furthermore if the people entrusted with the controls of these organizations are themselves ill qualified to carry out their tasks, then where are Malaysian Muslims to turn and what recourse do they have when the system (inevitably) fails to operate in a just and truly Islamic manner?

HSBC warns employees not to participate in BERSIH 3.0?

Saw this tit bits in Zorro's blog. It seems HSBC our "World's local bank" has warned that employees found participating in Jom Duduk Bantah this coming April 28 risk losing their job.

If true, it is another sign of UMNO/BN panicking. Why else would they go to this extend of even engaging a corporate to prevent people from helping apply pressure for a real and free election.

Let's look for the fall of UMNO/BN as it looks like they have sensed that they are in trouble.

The Election Commission Chief Abdul Aziz Mohd Yusof should be held responsible for the shocking amendments to the Election Offenses Act.

He made a fool of himself by declaring that Malaysia's Electoral Roll is the cleanest in the world but almost immediately, a secretly captured video showed EC officials conspiring with an UMNO leader's son and the NRD (National Registration Department) to commit gerrymandering in Malacca.

BERSIH 3.0 led by Ambiga is demanding he and the rest of EC resign.

Malaysians, please let us all work together to help makes that happen by attending BERSIH 3.0 Jom Duduk Bantah this coming April 28 at Dataran Merdeka.

EC will not allow replacement polling/counting agent even if the original agent does not turn up due to an emergency.
EC can now remove polling/counting agents from a polling station at their whims and fancy.

New amendment says NO MORE BARONG OBSERVERS!!!
Barong observers are the only outsiders besides EC staff allowed to vet the IC numbers.
It serves as a "preliminary screening" to weed out phantom voters.

The 50m exclusion zone outside the polling center is now extended to 100m or more, depending on the EC to decide.
This makes it impossible for election monitors such as MAFREL to see anything illegal going on.

They stopped the clock in Parliament for self-serving ends.

Malaysians must participate in BERSIH 3.0

I was at the first BERSIH protest in 2007. I missed BERSIH 2.0 because of an impending trip to Google Campus in Mountainview, California. Come April 28 baring unforseen circumstances, I will be at BERSIH 3.0 to help put pressure to put further pressure on the EC and the federal government for reforms and clean and fair election.

And Malaysians must join us. Why? Because the EC (Election Commission) and the UMNO/BN federal government will never willingly give us a really free and fair election and the 13^th General Election will as expected be the dirtiest election in history.

They have rammed through the amendments of the Election Offences Act, 1954 together with another 7 bills and have thus resulted in monitoring and prevention of electoral fraud very very difficult if not impossible.

What are those changes?

1. cannot establish identity of voter anywhere in constituency, 5k fine or jail
2. no barung agent (monitoring agents) at registration booth
3. polling and counting agents only allowed at time stipulated by EC
4. deleted provision for all printed documents to have printer & publisher name & address

DAP Ayer Keroh ADUN Khoo Poay Tiong has revealed a secretly taped video clip purportly showing an UMNO leader's son, NRD (National Registration Dept) and EC (Election Commission) officials conspiring to pursuade university students to change their addresses and to transfer their voting place to the Bukit Katil parliamentary constituency which is a marginal seat.

PKA top management bunch of idiots

The current PKA (Port Klang Authorities) comprising PKA chairman Teh Kim Poh (former MCA Pandamaran ADUN), Adnan Abidin, PKA financial manager, Captain David Padman, PKA general manager and Chia Kon Leong, PKFZ CEO are bunch of idiots who could not satisfactorily answer journalists questions over the PKFZ multi-billion scandal in a press conference.

They don’t know how many court cases are being pursued, why PKA paid bondholders when KDSB was the company that obtained the funds by the bond issues.

While claiming that they had not dismantled good governance and transparency practices put in place by Ong Tee Kiat, they could not answer questions over why there is only 1 independent director when OTK specified a minimum of 3.

They also could not satisfactorily answer why PKA withdrew the complaint to the Bar Council against law firm Rashid Asari & Co which was accused of conflict of interest.

A press conference called by the Port Klang Authority (PKA) to refute the allegations related to Port Klang Free Zone (PKFZ) scandal turned into a public relations disaster when the PKA management failed to give satisfactory answers to questions raised by the journalists.
The press conference held at PKA office in Port Klang today began with PKA chairperson Teh Kim Poh's (left) assurance that current Transport Minister Kong Cho Ha had never issued any instruction to PKA not to proceed with the PKFZ court cases or to squirrel away evidence.
"I can swear to you. If you want me to swear anywhere, I can swear. Please tell the truth," said Teh, the former MCA assemblyperson for Pandamaran.
Teh called on all quarters to respect and have trust in the court, and allow due process.
"If the attorney-general wants to charge more people, let him charge," he said.
‘Lee's book is outdated'
Teh also took a swipe at his predecessor Lee Hwa Beng's newly-published book PKFZ: A Nation's Trust Betrayed, describing its content "outdated" as PKFZ has achieved vibrant development under his stewardship in the last six months.
He even described former transport minister Ong Tee Keat's statementpublished inMalaysiakiniyesterday as "fabrication".
A dispute then broke out when R Nadeswaran, an editor with English daily The Sun, who has been following the PKFZ issue since the scandal was exposed, blasted Teh on why PKA continued to makepayments to bondholders although the bonds were issued by KDSB, the turnkey developer of PKFZ.
"You never took the loan, why are you paying back? It is not your money, it is all our taxpayers' money and you don't care about our money?" he asked.
Failing to satisfy Nadeswaran with his explanation, Teh passed the ball to PKA financial manager Adnan Abidin, who could only argue that PKA had signed an undertaking to repay the bonds but declined to reveal details of the grounds that the matter is being heard in court.
Nadeswaran also questioned why PKA insisted on making the payment, even though it was against the advice of Skrine & Co, the legal firm engaged by PKA earlier to recover the funds paid to KDSB.
The apparently clueless Adnan  replied that he could not comment on the legal advice, and that he had not read it.
KDSB is a company formerly owned by BN Backbenchers Council chairperson and Bintulu MP Tiong King Sing. It funded the PKFZ development by issuing bonds to four Special Purpose Vehicles (SPVs).
Under the agreement, KDSB obtained the funds from the bonds issued and PKA agreed repay RM4.6 billion to the bondholders over a  span of 11 years from 2007 to 2017.
According to Ong, RM3.039 billion is estimated to have been paid to KDSB bondholders to date, with another RM733.37 million due on June 20 this year.
Reporters at the press conference were dumbfounded again when Teh and his colleagues, including PKA general manager Capt David Padman, PKFZ chief executive officer Chia Kon Leong and Adnan, could not state the number of civil suits brought by PKA to recover the taxpayers' money.
"What is this? How do you run the organisation? The CEO is sitting here, the chairman is here but they don't know the status of the cases. How many cases? This is the reflection of the incompetence and the mess we are in because of this," said Nadeswaran.
Teh then scrambled to call PKA legal adviser Fadzilah Surkisah into the meeting to give the answer - which was four.
Another journalist quizzed Teh on why PKA should pay the bondholders when KDSB, which had obtained the funds from the bonds issue, was being sued by PKA for overcharging and non-completion of work.
"I cannot answer this. It is already in the court, let the court case take its course," Teh replied, giving the same argument.
Still sourcing independent directors
On Ong's claim that PKA had dismantled all the corporate practices that he implemented in PKFZ to ensure good governance and transparency, Teh claimed that all the practices were still intact.
However when a journalist asked about the fact that currently only one independent director was on the board of PKA, against Ong's decision to appoint three independent directors, or one-third of the 10-member board in order to ensure checks-and-balance in the PKA, Teh again appeared oblivious.
He replied that there was still one vacancy for an independent director before other journalists corrected him that there are actually two vacancies.
"We have actually wanted to (appoint independent directors). (There are) some recommendations from people, but unfortunately the persons refused to accept the appointment, so we are still sourcing now," Teh said.
The journalist then pointed out that the two directors seats had been vacated for more than a year.
After a short pause, Teh replied, "it will be filled up as soon as we able ".
Teh and Nadeswaran(right) engaged in another spat when the latter questioned the reason behind PKA's decision to withdraw its complaint to the Bar Council on Rashid Asari & Co - the law firm which was accused of  being in conflict of interest situation in an audit commissioned by Ong.
Teh argued that the Bar Council could still take action against the legal firm, even though the complaint had been withdrawn.
But Nadeswaran continued to press for the reason for the withdrawal of the PKA complaint and Teh ended the spat by confessing, "In that case, I don't know law".

Selangor made it possible to report dubious voters in electoral roll

Malaysians need to pay RM50 in order to report a single voter to the EC (Election Commission). This will make it very taxing on the wallet for those individuals or groups to report a long list of dubious voters, and there are reports of very numerous dubious voters.

Batang Kali constituency experienced a 40% increase in voters in the electoral roll. Even setting aside your distrust of EC and UMNO/BN, can you believe that it is via genuine registration of genuine and not phantom voters?

The Selangor government will launch a "Selangorku Bersih" programme involving state civil servants and village heads to ensure that the electoral roll in the state is clean and in order.
Selangor Menteri Besar Khalid Ibrahim told the media after a meeting with the Election Commission that the programme would be a "measure from the state to help EC to clean up its electoral roll in Selangor".
Khalid said the state would use funds for this from the RM5 million grant set aside under the Geran Selangorku scheme to enable any individual or party to raise objections on dubious voters in the electoral roll.
Khalid, Selangor assembly speaker Teng Chang Khim and a delegation of Selangor exco members were at the EC headquarters in Putrajaya today for a briefing by the commission and to discuss issues pertaining to the movement of voters' polling stations without their knowledge.

Pakatan Rakyat had claimed that as of December 2011, there has been a sudden rise in the number of voters in the state, amounting to about half a million individuals or 35 percent of Selangor voters.
Coalition supremo Anwar Ibrahim had said Selangor will not go for its state-level polls until the matter is resolved.
When asked about this today, Khalid said he did not raise the matter to the EC today because it is beyond EC’s jurisdiction to decide when the state is to hold an election.
Briefing reaffirms existence of voter spike
Meanwhile, Selangor senior exco member Teresa Kok said that the EC’s briefing has reaffirmed the existence of a spike in dubious voters.
“In Batang Kali (state) constituency alone, there is a 40 percent spike of new voters since 2008, making the total number of voters to 39,928 now.
“But Batang Kali is a semi-rural constituency, where  did the voters come from?” she said.
She added that the neighbouring Kuala Kubu Baru state constituency had not recorded such a significant increase.
Besides Batang Kali, Bukit Lanjan has also recorded a 34 percent increase in voters, followed by Paya Jaras with 31 percent.
Asked about the claim that a large number of East Malaysians have registered themselves as voters in Selangor, Khalid said the EC has given the explanation that it is done according to procedure.
“We were told that eligible voters can register to vote in Selangor. The validity is determined upon application for registration,” he said.
Khalid said he tried to press for exact figures on  the matter, but was told it is being tabulated.
“The EC said the figures are still being tabulated because there is a surge of voters.
“It said that on March 30 alone, 5,000 people were registered to vote in Selangor,” he said.
On his own voting status, Khalid said he has applied to move his voting constituency from  Lembah Pantai, Kuala Lumpur to Ijok, Selangor.
Khalid also dismissed the theory by an Umno blogger that being a KL voter would disqualify him from contesting a state seat if he fails to change his voting constituency, saying that the criteria examined is the address on the identity card.
When asked about the MCA’s accusations that Selangor deferment of its elections is a stunt to siphon its money to campaign activities elsewhere, Khalid declined to comment.
Exco member Halimah Ali, who was standing beside Khalid, then quickly went to his defence, quipping  that “even the selangor exco has found it hard to get a cent from the government”.

However, the expected broadcast on March 25 did not take place. Very likely, Fuziah did a good job and put Raja Aziz and KL Tan to shame. Had the DG of AELB and Tan been able to put up a good case for Lynas, you can be sure it would have been broadcasted.

AELB "no comment" stance confirms China wants Lynas plant closed

Raja Abdul Aziz, Director-General of AELB (Atomic Energy Licensing Board) declined to comment when asked if stakeholders of the planned China-Malaysia joint-venture industrial park near Lynas Advanced Materials Plant (LAMP) had asked for LAMP to be scrapped.

Now if those reports were false, Raja Aziz would surely have denied it. The fact that he dared not comment implies those reports were true.

Nizar: Abolish National Service and BTN

According to Nizar Jamaluddin, former Perak MB (Mentri Besar), Malaysia wasted RM650 million on PLKN (National Service Training Programme) and another RM500 million for the hated BTN (Biro Tata Negara) annually.

He said these 2 programme should be abolished (and I suppose the funds channeled to more useful objectives such as real education).

Najib helped Altantuya get French visa in Malaysia?

Mongolian citizens can only be issued visa to enter France in Mongolia. However, Altantuya Shaaribuu obtained such a visa in Kuala Lumpur, according to her father Setev Shaaribuu.

How was that possible. According to Setev, Razak Baginda requested Najib Abdul Razak to help her get a French visa. Could that be true?

Can a Mongolian national be issued a visa to enter France while in Malaysia?
The answer is no, says a Foreign Ministry official from Mongolia, who is puzzled that Altantuya Shaariibuu obtained such a visa when in Malaysia - about one or two years before she was brutally killed.
The officer, who was in Malaysia with Setev Shaariibuu (left), the father of the murdered translator Altantuya, said Mongolians must apply for, and obtain, foreign visas in their own country, not abroad.
"There is no way anyone of us can get a visa while in another country. We will be told to return to our country to apply for it," the officer, who did not want to be named, toldMalaysiakini.
At a meeting with human rights group Suaram on Monday, Setev had expressed bewilderment that his daughter's visa to enter France had been issued in Malaysia.
"Altantuya told me that she had obtained the visa and would be travelling to Germany before going to France," he said in the presence of Suaram activists, including its director Cynthia Gabriel.
"My daughter told me that Razak (Altantuya's companion - political analyst Abdul Razak Baginda) had requested the assistance of Prime Minister Najib Abdul Razak (then deputy prime minister and defence minister), and she was issued a visa under the name Amina Abdullah," he claimed.
"All these happened sometime between 2004 and 2005, before her death in 2006," Setev added.
Setev also claimed that Razak tried to obtain a visa for Altantuya to enter Britain through his contact at the British High Commission in Kuala Lumpur.
He said Altantuya told him that Razak's contact at the high commission had agreed to help her, but then she left Malaysia before she could get the visa.
Who was Amina?
During the 2007 murder trial of the two police officers who were charged with killing Altantuya, the name ‘Amina' cropped up as one of her ‘names' and speculation then was that Altantuya had married Razak and converted to Islam.
However, Setev had at that time refuted the claim, saying Mongolian parents would sometimes address their eldest or first-born child as ‘Amina', which means "my life, my own".
Setev was on a three-day visit to Malaysia to seek closure to his daughter's murder and has been pleading for an end to delays to a RM100 million civil suit he filed in 2007 for sufferings incurred by his family as a result of Altantuya's (right) untimely and cruel death.
He has named Razak, the two police officers who were subsequently convicted of murdering Altantuya - Azilah Hadri and Sirul Azhar Umar - and the Malaysian government as respondents in his suit.
Razak was acquitted of abetting in Altantuya's murder without his defence being called, and the fact that the Attorney-General's Chambers did not file an appeal on this matter raised eyebrows.
Following Razak's acquittal, human rights NGO Suaram filed a case against French shipbuilder DCNS for allegedly paying kickbacks to top Malaysian officers.
The commissions were said to be for the purchase of two Scorpene submarines by Malaysia in an RM7.3 billion deal inked in 2002 when Najib was defence minister.
Setev has agreed to be a witness in the case, which he claimed is linked to his daughter's grisly murder. The court case has recently opened in France with two investigative magistrates being appointed.
Get Burmaa to testify
Setev also said that the French court should subpoena Altantuya's friend Burmaa Oyinchimeg, who was a witness in the murder trial of the police officers Azilah and Sirul, whose appeal against their conviction and death sentence is set for hearing in August.
Burmaa (centre in photo), who was the prosecution's sixth witness, caused a stir during her testimony when she said she had seen a photograph of Altantuya with Najib and Razak.
Najib has denied ever knowing or having met Altantuya, but Setev had insisted yesterday that he had also seen "with his own eyes" a photograph of Altantuya, Najib and Razak.
However, he said at his meeting with Suaram, Burmaa began fearing for her life after she testified in the Malaysian court and has since fled Mongolia.
